A sad day!!

    Hi Folks,

    I dunno if you read my intro.. I'm a avid wagon collector.. I just acquired a very nice 1975 Buick wagon or so I thought! Today the seller already sold the car I bought!!

    I live in England and I wired the money last Saturday (well Monday since nothing gets done on Saturdays) and the money has long ago left my account...

    Today I got a email from Tim at Airport Auto Sales telling me that he has sold the Buick to somebody else.... saying my funds hasn't hit his account yet. Still last Saturday I got a thank you email from him for sending him the money..

    I'm already in contact with a lawyer since this is borderline on selling something that he already sold and in principal isn't his.. However that is not the worst thing!! What is the absolute saddest thing is that I been looking for that Buick wagon for a very long time and then when I bought it
    it's getting sold against my will so to say!

    I guess most of you know the wagon since it's even featured here....

    Yes, we did look at the car here too. It surely looked like a clean car! Sorry for your loss, but I hope you will get at least your money back!

    It is a very nice wagon (had extra pic to verify the condition) I will probably hire a lawyer. You can't sell something that is already sold. Thats like taking two checks and the one that clears first is the winner. Contractually that is not ok since the one that was there first with the check is the one that is the buyer....

    That really sucks. Did you have a contract?
    Step #1 Contact your bank and make sure the money did get to his account
    Step #2 Get all the info you have on the deal including emails.
    Step #3 Make a police report to your local authorities
    Step #4 Contat his local police department and send them a copy of your report from your authoritieshttp://www.duluthmn.gov/police/index.cfm

    When I was 16 I put a deposit down on a 73 Plymouth Fury sport. It was a Saturday, back in the day before ATM's. I came back Monday and the ar was sold. The salesman said that the deposit was for him to hold the car and he couldn't control what other salesman did. I was furious and just took my deposit back.

    Oh my, how dreadful! Hopefully you can resolve it.

    I was wondering if it was that stunning wagon. I hate it happened. Maybe you all can work something out.

    I was interested in that Country Squire wagon, but it ended up being a rust bucket.

    Hi Folks,

    Thanks for the support. First off technically it isn't fraud yet, well if he doesn't refund it is. However I don't really care about that part - well I do care about my money - but I care more about the wagon. I bought it, I turned my mind into the fact that is was in my hands...

    I searched for a low mileage high optioned car within my budget for a long time. Well the whole thing just makes me sad and angry!

    I had my lawyer contact him but he didn't budge, it's sold to that other guy because his funds cleared first even if they where sent later (i.e. sold later and sold a second time). What makes totally mad is that he didn't even tell me to provide him with a downpayment via Western Union or similar.

    Of course the seller will not budge. He has been paid. Cash in hand always beats a promise. Who knows, perhaps someone else called him after you bought it and offered a few dollars more to steal the deal from you. Either way it shows a lack of integrity on the sellers part.

    Try contacting the States Attorney General in the sellers State. I guarrantee you they will act on it and at least get you your money back.

    It's a business so I'm not to worried about not getting my money back. If they don't it's very easy to sue for a "little bit" more than the amount so to say.

    However that is as said not the thing this is about. He sold a car twice. He never even contacted us when the other seller was about, asking if we e.g. had a wire confirmation number or anything he just said to him self if I get twice the money I don't' really care I can just send it back.. I sent a complaint to the bbb so I hope they will get listed as a unethical company...

    I have a lawyer so I'm feeling safe :)...

    Dyna, sorry to hear about that. It's just not right and it's really sad that there are such crooked folks out there. I really hope you get your money back and he'll get his in the end. Carma always gets it's next victim. So hang in there and keep smiling. :)

    Hi Folks,

    Though a update was in order. Air port auto did bounce the wire transfer hence I got a majority of the money back. However with wire fees in both ends and also currency exchange rate both ways (which never is at your advantage) what I actually got back was about 300 pounds short (thats about $500)....

    Now they told me in a email that they will refund "I'll make sure to immediately refund you " is what they wrote in a email to me. They also informed my lawyer that they would refund all my cost.. Here is what my lawyer wrote to me after he had spoken with them. "He offered to cover any de minimis costs associated with this wire transfer you may have incurred".

    Now last week when I got the money I got a statement from the bank with all the figures on and I scanned and email this to Airport Auto, with instruction that the emailed me when they sent the wire with the money they owe me. So today when I haven't heard from them since I called and emailed them last week I thought I would call them....

    Now the sound was different they told me they where in contact with their lawyers to see what they legally could do and that he was in no position to talk to me and then they hanged up the phone. I called up a bit later and they hanged up again..

    Well to me it sounds basically like "your favorite four letter word" you/off/whatever, you will not get your money -- we know you are on the other side of the pond and you will not come here to collect kind of ...

    Well well will call my lawyer again to see what options I have -- I have already done a BBB complaint -- next I think is to call the police but my lawyer should be able to tell me what the best move is..

    Wow, sounds like a mess! Hopefully you will get it settled.

    I know a lady that had a bum deal that reminds me of yours. She had bought a 1970 Buick Estate Wagon. The seller had made it look nice, but it was not. After a couple of days, the car would not shift and it would eventually only go in reverse. One days she pulled into work and I could not help but chuckle... she had stopped right in the parking lot and was shifting the gears up and down... yelling "piece of junker- you fodder- shift you- no!" lol. She went into the office and I heard her screaming on the phone. I will never forget that conversation because her recorder was on and we listened over over... she said, "Rebel Motors, I want you around here now, with another car"! Apparently he said "caveat emptor" and she called him a low-life liar and then she said "I am going to sue you and I am burn down your showroom and when I am finished with you, your gonna to look like roadkill!" - then she said, "you what? you- huh?" Then she heard everyone listening and hung up the phone.:D Needless to say, he gave her the money back, but it was still so funny.

    Hope it goes better for you and you get your funds back!
